Welcome to Blank. These Terms of Service ("Terms") govern your use of the Blank mobile application ("App") and related services (collectively, the "Service") operated by Blank ("we," "us," or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 13 years old to use Blank. If you are between 13 and 16 years old and located in the European Union, you may need parental or guardian consent to use certain features, as required by applicable law.
By using the Service, you represent and warrant that you meet these age requirements.
2. Account Registration
To use Blank, you must create an account with accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.
3. Service Description
Blank is a social media platform that allows users to create and share content, interact with other users, and build communities. Features may include posting text, images, audio, and other media, as well as following other users and engaging with their content.
4. Subscription and Payments
4.1 Free Beta Period
Blank is currently offered free of charge during our beta period. We will provide advance notice before introducing paid features.
4.2 Paid Subscription
Following the beta period, Blank will transition to a monthly subscription model. Subscription details, including pricing and features, will be communicated before any charges apply.
4.3 Billing
Subscriptions are billed monthly through Apple's App Store. By subscribing, you agree to Apple's payment terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
4.4 Refunds
Refund requests are handled by Apple according to their refund policies. We do not process refunds directly.
5. User Content
5.1 Your Content
You retain ownership of content you create and post on Blank ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content solely for operating and improving the Service.
5.2 Content Responsibility
You are solely responsible for your User Content. You represent that you have all necessary rights to post your content and that it does not violate any third-party rights or applicable laws.
5.3 Content Removal
We may remove User Content that violates these Terms or our Community Guidelines, without prior notice.
6. Prohibited Conduct
You agree not to:
- Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Engage in harassment, bullying, or intimidation of other users
- Post spam, unsolicited advertising, or promotional material
- Impersonate any person or entity
- Post content that infringes intellectual property rights
- Attempt to gain unauthorized access to the Service or other users' accounts
- Use the Service for any illegal purpose
- Interfere with or disrupt the Service
- Collect or harvest user data without consent
- Post content depicting or promoting self-harm, violence, or dangerous activities
- Share misinformation or engage in deceptive practices
- Create multiple accounts to evade bans or restrictions
Violation of these rules may result in content removal, account suspension, or permanent termination.
7. Reporting and Moderation
We rely on our community to help maintain a safe environment. You can report content or users that violate these Terms or our Community Guidelines. We review reports and take appropriate action, which may include content removal or account termination.
8. Intellectual Property
8.1 Our Rights
The Service, including its design, features, and content (excluding User Content), is owned by Blank and protected by copyright, trademark, and other intellectual property laws.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
8.3 Feedback
Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation to you.
9. Third-Party Services
The Service may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of third parties.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLANK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
12. Indemnification
You agree to indemnify and hold harmless Blank and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
13. Termination
13.1 By You
You may delete your account at any time through the App settings or by contacting us.
13.2 By Us
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.
13.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, indemnification, and limitations of liability.
14. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of the European Union and the member state where Blank is registered. Any disputes shall be resolved in the courts of that jurisdiction.
If you are a consumer in the EU, you retain the benefit of any mandatory consumer protection provisions of your country of residence.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blank regarding the Service.
16.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
16.3 Waiver
Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
16.4 Assignment
You may not assign your rights under these Terms. We may assign our rights to any successor or affiliate.
